    Basically judicature institution that had power to check and administer the law the petition of adoption was State Court. With the enactment of law number 3rd of 2006 about Islamic Judicature, especially for moslem aplicants the authority submitted to Islamic Court. But in the fact, State Court still receiving and determining adoption filled by Moslem aplicants. This case appeared problem toward competency of a court in adoption. Based on the results of this research after the enactment of Law number 3rd of 2006 concerning about Islamic Courts, the authority of State Court only to judge petition for adoption applicants other than Moslem, and for the moslem applicants the authority is under islamic Court.
